I was Involved in Car Accident, What now?
1) After a car accident the first thing you should do is get medical treatment. It is recommended that you are medically evaluated as soon as possible and not wait for the pain or symptoms to persist. This is important for two reasons.
· One, after a car accident, the extent of our internal injuries is not known right away. When one is involved in a car accident with other vehicles, right after the car accident, one may not feel much as adrenaline is pumping through your body subsiding some pain and symptom. However, this does not mean that you may not be suffering from internal injuries as a result of a car accident.
· Two, treatment as soon as possible is recommended. A delay in medical treatment after a car accident may be used as a defense against you later on in litigation. This is a point that defense attorneys love to use to minimize your legitimate injuries after a car accident.
2) Take pictures at the scene of the car accident. DO NOT DO THIS UNTIL YOU ARE AT A SAFE DISTANCE. After the car accident and once you have accessed that you are safe, take pictures of the damages to the vehicles involved in the car accident, pictures of any people that were involved in the accident (do this safely from a distance if possible), pictures of area of where the accident took place. If the other driver involved in the car accident tells you that they did not see you because of xyz, then try to take pictures of what they are talking about. These photographs will assist in proving liability against the other driver and show that you are not at fault for the car accident.
3) Gather information of those involved. If you can and if it is safe, attempt to take the information about the other drivers involved in the car accident. The information you should ask for is the following:
· Names
· Picture of their Drivers License
· Proof of Insurance
· Name of any witnesses
· Statements that the other driver or witnesses made at the scene
The police should always be called after an accident. That police officer will access the scene and then ask you to move the vehicles if possible and if it hasn’t already been done after the accident. In South Florida (Miami, Ft. Lauderdale, and West Palm Beach) along with the rest of the state, the police officer on the scene should give you an Exchange of Information sheet. If completed correctly, this sheet will have all the information on all those involved in the car accident.
Who Pays for My Injuries?
There are certain type of insurances that are used when making a personal injury claim involving a car accident. When handling a car accident, Solorzano Law, PLLC will always try to make a claim against the at-fault insurance company and not your own.
